The decision of the arbitrators will be in writing with written findings of fact and will be considered final and binding on all parties. The arbitrator will be empowered to award money damages, but will not be empowered to award direct, indirect, incidental, special, or consequential damages, or specific performance.

Each party will bear its own costs relating to the arbitration proceedings, regardless of the outcome. This section provides the sole recourse for the settlement of any disputes arising out of, in connection with, or related to these terms. Notwithstanding the foregoing, any action seeking injunctive relief will be submitted to the courts and will not be subject to this provision.
